Woman avoids jail after 'very drunk' sex with boy, 14
AAP
November 18, 2009 10:52am
A 41-YEAR-OLD woman who had sex with a 14-year-old boy during a drinking binge has avoided a jail term.
Jenny Lee Mitchell had sex with a 17-year-old boy and then his 14-year-old friend after they had spent the night out drinking between February and March last year.
Victorian County Court heard she was very drunk and had little memory of what happened.
Judge Howard Mason said her drunken state explains her behaviour but did not excuse it.
But he said her appalling history of neglect and abuse, psychological problems and her alcohol dependence after being weaned off pain medication, and otherwise good character made for exceptional circumstances.
Mitchell, of Sebastopol in Ballarat, pleaded guilty to one count of sexually penetrating a child under 16.
Judge Mason sentenced her to two years' jail, with the sentence wholly suspended.
Mitchell, who sobbed as she was sentenced, will be registered as a sex offender for 15 years

discuss the implications of double standards within the justice system, and what would have happened if a 41yr old man had had sex with a 14yr old girl. provide case studies if need be.
