Hey there,

New law introduced this year called Family Law Amendment (De facto Financial matters and Other measures) Act 2008.

This Act recognizes De facto relationships under Commonwealth law and if a de facto couple breaks up, they can go to the family court for property settlement, maintenance etc.

Does this mean that the Property (realtionships) Act 1984 in NSW does not apply anymore because commonwealth law now deals with it.

Hope there are some answers out there,

For De Facto relationships that have broken down on or after March 1st 2009 Commonwealth jurisdiction applies for nsw as per this amendment to the Family Law Act 1975 (Cwth). However, for relationships that broke down before March 1st are still covered by the Property (Relationships) Act 1999 (NSW) unless they explicitly state their intentions to be considered under the new Commonwealth system. you can find more details here: New De Facto Property Regime
