Attention all students wishing to discuss or to otherwise review copyrighted material.

The reproduction of entire examination papers or commercially published solutions constitutes an infringement of the copyright in the work: s 36 of the Copyright Act 1968 (Cth). One or more users recently posted material allegedly extracted from a publication of Aaron Butler Publishing relating to examination solutions. Aaron Butler Publishing has specifically requested us to remove the material in question, and we have complied with their request.

Reproducing a "reasonable portion" of the material for the purposes of research or study may be permissible: s 40. Note that the relevant purpose is that of the person who is reproducing the work; it is not sufficient to be publishing the work for the research or study of others. Unless you are personally asking for assistance with a specific question, any reproduction of the material is likely to be an infringement.

Infringement may also be avoided where portions of the material are reproduced for the purposes of criticism or review: s 41. It is not sufficient to merely reproduce questions for the critique and review of the public at large; the criticism or review must be genuine and must have a real connection with the reproduction. You would need to be personally undertaking some sort of critique or review of particular questions.

Solutions which are wholly the work of students may continue to be published.

that "reasonable portion" for "Education" purpose is one chapter or 10% (whicever is greater).

Now chaptain ghey put the solutions to the 2004 HSC Physics Solutions. Which I believe is one chapter of the book and it is for educational purposes.

Therefore, he should be allowed to post up such things.

Though I could be wrong.

All chaptain grey was doing was trying to help out someone elses request and I am sure wasn't trying to do anything wrong. I hope he hasn't been banned.

Copyright law is never black and white and as I am not a lawyer, am not going to argue the point. I am also sure Lazarus does not want to go through legal cases over this. There is also the other considerations, not just the quantity he has mentioned in his original post.

it's just i feel sad that Captain Ghey went to such trouble only for it to be deleted.

I did end up getting a copy.

You have to remember that you can only legally reproduce that "reasonable portion" if it is for YOUR research or study - not for the research or study of others. Obviously, if it's only for your own personal research or study, there's no reason for you to be reproducing the materal on public forums.

It's unfortunate, but there is nothing I can do.
