yeah, that's where the comparison falls down (quite easily). the comparison was quite clearly a joke. the law is actually based to a large extent on culpability. the criminal act in drink driving is knowingly and intentionally compromising your own ability to operate a motor vehicle safely, then operating aforementioned vehicle and thus endangering the lives of others beyond what can be considered reasonable (note: the act of driving itself endangers others lives, but cannot be considered a crime itself).
