AN IRAQI asylum seeker who confessed to raping a 10-year-old boy in a swimming pool, claiming it was a "sexual emergency", has had his conviction overturned. In a truly shocking twist the Suptreme Court decided the grown Iraqi man may not have realised the 10-year-old did not want to be sexually abused by him. Amir A, 20, was visiting the Theresienbad pool in the Austrian capital of Vienna last December as part of a trip to encourage integration.

But I don't get it... shouldn't he have been charged with statutory rape anyway?

From the article:

"In the initial court hearing, he was found guilty of sexual assault and the rape of a minor and was sentenced to six years in jail."

It's worth noting that he is being retrialed and held in custody, not getting off scot-free. The title of the thread is misleading.

"According to the Supreme Court, the first court should have ascertained whether the offender had thought that the victim agreed to the sexual act and whether Amir A. had the intention to act against the will of the boy.

The rape case therefore must go back before the regional court. According to Austrian law, the sentence was also lifted. In the second legal process, which presumably will only take place in 2017, a new sentence must be imposed. The 20-year-old is expected to remain in custody until then."

the fact that this case was even thrown out at all is absolutely horrifying regardless of what ends up happening

the judge deserves to be hanged

the fact that this case was even thrown out at all is absolutely horrifying regardless of what ends up happening

the judge deserves to be hanged
The case isn't being thrown out, he's being held in custody until he is retried because the judge wasn't completely satisfied with the rape verdict.

Either way, 'He didn’t know the boy didn’t want to be raped' <--- anyone within the field of law willing to accept that as a legitimate excuse is questionable.

the judge should be drawn and quartered along with the rapist
