Distinguish between awards and enterprise agreements--2 marks

What's the difference?
This is whatIndustrial Relation Commission said

Awards apply to employers and employees depending on the industry they work in and the type of job worked.
Awards don't apply when an employer has an Enterprise agreement in place. Enterprise agreements set out minimum employment conditions and can apply to one business or a group of businesses.

Would you guys say this is a full 2 marks answer?

This information seems sufficient to be awarded the full two marks. I would add the fact that awards set the minimum rates of pay and employment conditions for a particular industry and that, should a business use an enterprise agreement, the minimum rates of pay and employment conditions cannot be lower than the relevant award. The employee's rights under the agreement must surpass those in the applicable award.

That’s correct. In the case of creating enterprise agreements, the employer is usually one party in this process, and would be engaged in negotiations with its employees and/or their representatives. This process is called enterprise bargaining.

Highly insensible to have copied this answer directly from a government website. You should try and put it in your own words to avoid direct plagiarism.

Essentially awards are a general template for everyone in an industry and an agreement is a modified version of the award used by specific companies.

If a given firm lacks an enterprise agreement, the award will act as their default enterprise agreement.

Agreements will almost always contain everything from the award but may also specify additional things. Eg min award hours in an industry might be 3 per shift, but a specific employer might choose to specify a minimum of 3.5 hours in their specific industry enterprise agreement.
