    But D relates to the Wik decision. I think C was just phrased oddly, 'traditions and customs' just mean that they have a connection with the land, which is what was needed for Native Title.

    Hmm, could be, but this is what I have in my notes: Native title is the recognition of the existence of common law rights of Aboriginal and Torres Strait Islander people to use and occupy lands and waters to which they have maintained continuing traditional connection.

    Oh my God I'm sooo scared I did that on my English paper... I didn't write my number during the exam and quickly scribbled it down whilst they were collecting the papers.

    Oh yes, you're right! I've got this in my notes: 1996: Wik Case: The High Court's Wik decision found that native title could coexist with other land interests on pastoral leases, which cover some 40% of the Australian land mass. So yeah, answer is C.
