court hierarchy (1 Viewer)

hey i was just wondering where the nsw court of criminal appeal and the nsw court of appeal fit into the court hierarchy..(or are they the same thing? :confused: ) my text book has conveniently left out both of these courts. help please!

Both of those courts are in between the supreme and high courts.

This is because if you don't like the decision of the supreme court, you can appeal, and since no criminal court cases go to the High Court, it will go to the Court of Criminal Appeal, or Court of Appeal (depending on the offence).

These are two courts on the same level. They are the next level of appeal from the SUpreme Court. The Courts of Appeal are still apart of the supreme court. Strange thing, the Supreme Court has Judges and a Chief Justice, the Appeal Courts have Justices of Appeal and a President, the Chief Justice (if at odds which is unlikely at all) would still be seen as the more superior officer (not in terms of precedent though).

hmmmm,

Criminal case CAN go to the High Court. The High Court has an appellate jurisduction on ALL cases in Australia. You can appeal but you have to seek 'leave', and if granted, you will get your turn in the High Court.

The whole idea of the Two appeal courts (CCA and CA) is to have judges specialising in their area. Remember remedies and nature of cases are very different between criminal law and civil law.

CHILDRENS COURT LOCAL COURT CORONERS COURT​
childrens court, local court n coroners court r on the same level
then it goes up from there
local, district, supreme, court of appeal and high court
the arrows didnt come out on here

sweet. ok cool but like the drug court and land and environment court etc arent in the syllabus so we dont need to know them yeah? like they can only ask us whats specified on the syllabus. is that right?

the drug court and land and environmental court arent on the court heirachy in our syllabus
just the ones iv said
local court, childrens court,coroners court-lowest level
then...
distirct court
then...
supreme court
then...
court of criminal appeal
then...
