This argument has no end, there are casses where you could kill a person because of what they've done. I suppose you don't really have any empathy with the victims until you actually are the victim. What if someone killed your sister/brother or gf/bf... U'd freak, u'd want their blood. I guess it's just not your place to act... Still think the legal system is dodgy.

Yes i agree there are a number of factors that need to be taken into account. But there are people out there that are cold blooded murderers. Perhaps a death penalty may make them think twice before taking someone elses life. But then again, capitol punishment in America seems to have done nothing to prevent these 'cold blooded murderers' killing. They have nothing to live for anyway. However. The NSW courts are pretty tough. Its generally the weaker decisions that make the media and generally those are appealed.
When the court does give a murderer 15 years it usually has reasons.
It is unfair to simply state that someone has killed someone and henceforce they deserve to die. There are a number of factors that need to be taken into account.
So do you actually beleive that the threat of the death penalty would prevent someone like seth gonzales from killing? Im not disagreeing with you that murders dont occur when the murderer is completely irrational, however, a lot of murders are planned - in rational thought - and perhaps in this state, the threat of being caught, of not getting away with the murder and virtually killing yourself at the same time, is enough to prevent a murder. thats just my opinion anyway.Asquithian said:Read what I stated previously. The death penalty only works to deter people in situations where they have time to be rational. Most murders occur at irrational heated moments where the person does not think of the consequences. Hence this explains why the the death penalty does nothing to do deter.
Most murders occur in the kitchen with a knife or with bare feet and arms. Why? Because people generally dont even think to grab a lead pipe or a gun. They grab the nearest thing or use their hands or feet.
Some people deserve to be killed. But the killing serves no purpose other than to get revenge. An 'eye for an eye'. Also the state should not encourage violence as a means of punishment. It inferrs that violence is the best way to punish. There are better ways to punish without violence.
However I think life is good enough in MOST circumstances. Never to be released. However Some killers (i'm thinking Seth Gonzales - Backpacker killer - Martin Briant from tassie) really do deserve to die. However in their cases they will die in prison. As life is now life.
