Address the question in relation to justice for the individual and justice for society.
Childrens rights are paramount, you need to discuss how this influences the administartion of justice.
Also, resource efficiency and the law as a reflection of societal views and values are important, as is utalitarianism. (Greatest good for the greatest number.)
Is the law easy to change when the need arises? is it equitable? Does it seek to redress inequalities and injustices?

Remember, when you assess the effectiveness you should pretty much be giving varying degrees of the same type of answer every time.

You don't want to state that the law is 100% effective, because it isn't, it never has been and probably never will be and at the same time you don't want to say that is is inneffective because no matter how bad or apparently inadequate the laws are they still are effective quite often and besides the markers generally approve of most of the legal system and you don't want to annoy them.

So what your answer should be pretty much is that the law is fairly effective but still encounters difficulties sometimes.

What you also need to adress is that diffirent groups within society have diifirent views. So that something that is effective for one group in society may be opposed by another group. When addressing the effectiveness and looking at society you don't have to say that sometihng is good or bad but rather this works for someone and this doesn't work for someone else.

For example: children almost always go to the mother in case's involving custody debate, as this is usually in the paramount interest of the child. This is effective for the child and the mother, however, the father may feel his rights are not being upheld.

When you are addressing a family question, you must think about all aspects of family law (children, same-sex couples, marriage/disolution of marriage)

Few tips to remember about family law:

- The best interests of a child is paramount. < -- priorty. This is done through: presumption of shared parenting, parenting plans etc.

- There is no legislation that allows same-sex couples to marry. They are unable to get married overseas and have their marriage recognised in Australia. John Howard recently has included the legal definition of marriage into marriage legislation so that same-sex couples aren't able to be acknowledged as married. Same-sex couples aren't able to adopt overseas or in Australia.

- Same-sex couples may be recognised as de-facto couples when living with eachother for more than two years.

- Same-sex couples may now apply for a dependant rebate (not sure the exact name) This means if your in a relationship and your partner dies and your usually dependant on their income, you can receieve money - not entirely sure on this though.

When answering an "evaluate the effectiveness" type question your weighing up the good and bad then making a judement. So .. blah blah is effective for individuals because, it may not been seen effective to those who are blah blah because blah .. the legal system may be more effective if ..

Thats just some basic information. If you practice writting essays regularly you will get the hang of things :) Hope that sort of helped :)

Look at the Syllabus.
It tells you exactly what to include.
Dont listen to what anyone else says. The syllabus is what examiners take into account when marking.

yep, like 'Joelef' said look at the syllabus, it is what you should go by, but not just for legal, all your subjects! ..........and it depends upon what the issue is, you may need effectivenness for the individual, society or both.

You need to examine the law in relation to the criteria (eg BRACE & REAPER) that is for the individual and society. BRACE is for society and stands for balancing individual and society, resource efficiency, accessibility, etc, and REAPER is for individuals eg resource efficiency, access, protecting indiv. rights etc (look in your textbook).

Once you have done that, you need to use LCMD (legislation, cases, media and documents) to support what you are saying. The rule of thumb in essays is to follow the TEER process for each paragraph, as follows:

T - topic sentence (what criteria you are going to use to evaluate the legal system
E - expand on this slightly
E - evidence - use your LCMD here to prove the point you are making
R - relate back to question asked

You of course need an intro and conclusion.

Don't retell the case, markers know what they are, what they want to see is how well you can make a judgement (evaluation) and how well you support this judgement (LCMD).

I uploaded my Family notes from when I did the HSC (Class of 2007), they spell out the effectiveness of law as outlined in the syllabus. Beyond that, I put 'issues to present in essays' at the very end of the notes - you can mould these to suit the question asked.

The notes were uploaded as "John T", so just CTRL + F on the page to find them!
