Just wandering if people know the difference between Formal and Real Equality.

there is no difference. Both are the state where everyone is treated the same by the law regardless of background, social or economic status or personal beliefs.

But I heard that Fromal equality refers to the theory of equality, and real equality refers to how it is in practice, for example Mandatory Sentencing, in theory is applies equally, but in real terms it may discriminate becuase more disdvantaged people are caught.

yep.. take the glass ceiling for women for eg..
they have a statutory right(formal equality) not to be discriminated against in the workplace under sex discrimination act, however, in practice they do not recieve equality of opportunity cos they are still discriminated against

Thanks, just wanted to clear that up, becuase although it is a simple area of the course, they still happen to write about a page on it in the text book.
