is there any way of finding out the evidence used in a particular case?? Cos (as i think i mentioned in another thread) i gotta do an assignment and i just want to find the evidence used by the crown and defence....like "Exhibit A, B, C" sorta thing. Any ideas? The only thing i have to go on is the case summary thing written by the judge off Lawlink.

Hmm... never head of finding it from anywhere before, you could always contact the court and see what response you get... otherwise, can't you say that the evidence in the case are the facts used in the trial, and the mitigating/aggravating factors that are tested by specialists?

go to that austill site and download the transcript. it'll have all the evidence if u can be bothered to read the whole thing

Yea, I thought you used Austlii, sorry... that's where all us Legal students in my school got told to go for our Crime assessment, you'll hopefully have a shortish case though and not have to read, and read, and read...

Aww... you got one of those cases... it's because Austlii is made by uni students, so there's a lot of inconsistencies in the transcripts, you must have had a lazy person :p

Evidence is delivered with "Exhibits" A to Z. There is no "Exhibit 'I'" though, as the court will use number and 'I' and '1' may get mixed up.

Exhbitis are used for the jury, as evidence, the number system is used for points of law that if the jury gets hold of by accident may change the outcome of the case. The jury are only the judge of facts, not the law, so the facts must only be presented to them.

for an assignment, we had to study a case and i used the austill site and my case did not reveal what the exhibits were.. perhaps it depends on what case you do.. but from what i know, i dont think you can find out what the exhibits were...
