hey can anybody help me
ive got an essay to do and it asks .. to
<b> "evaluate the efectiveness of the legal system in adressin the needs of families"</b>
its so broad . . i dnt know were to strt .. im so stuck and its worth 20 % . . any help would be greatly aprecciated

We haven't started the family component as yet but I'm going to take a punt that it's going to be the same as when you write essays about crime.

Generally, I write these sort of things a bit like a history essay in a reasonably chronological order. So you write a little about before the Family Law Act 1975 and then start to write about how that dealt with problems and how effective it was and measures, legislation etc since then. Back all that up with case law, newspaper reports and other documents.

Theres two ways you can do it:

You can do it in the broad sense and have a look at how the legislation pertaining to family law has changed and how this has addressed the changing definition and needs of the family. However, you run the very high risk of being too broad and not writing a concise essay.

The other way you can do it (and this is how HSC markers prefer it) is to choose 3 or 4 issues within the family syllabus (when doing my essays I chose de facto couples, same-sex couples, adoption, and the legal definition of a marriage) and then use a seperate paragraph for each to address the legislative & social issues surrounding these areas.

i had to do one like that for a human rights issue. i started off mine; by
1.saying the problem
2. things to help problem (ie. acts n legislation)
3. if they helped and ifs its been effective (statistics n news paper artcles r good here)

This is how i'd look at it:

Evaulate - in maths you are supposed to find a vaule, in english essays, it means to argue a point and come up with a result.

Effectiveness - main point of HSC Legal. HIGHLY subjective and tangible. Argue your case, but supply evidence at all times, back up statements etc.

I would then go on to assess issues within the Family Law system. (We havent begun family law yet, but i will do my best to help)

Some things i would comment on are: -
  • The inquisitorial nature of the court, as opposed to adversarial
  • Homosexual relationships (Property (Relationships) Act 1984)
  • Money and family law (Legal Aid) (NB: i think it is automatic if you need it for a case of family law)
  • Divorce (Residence [NB: not custody] of a Child, Best interests of the child, trend of residence, i.e. mother of father, assest division) Family Law Act 1975 (Cth), Family Law Reform Act 1995 (Cth)
  • Definition of Family
  • Autonomy of Children (i.e. ability of children to make thier own decisions)
  • Homosexual relationships and children (now there's a touchy subject)
  • Disipline re: children
  • Child Support
  • Polygamous Marriages (What if it is tradition for you?)
  • Intestate (Relating to the death of a spouse without a will being in place
  • and most importantly ADRs

that's all i can find, but it's more than enough for an 8-10 page analysis... trust me :)

Okay if you've got the Hineman Legal tectbook it goes through all the stuff related to effectiveness of the law. Essentially all you have to do is talk about all that stuff and how it relates to the needs of the various types of families. eg. Single parent families often don't have a lot of acess to the legal system for various reasons.

Effectiveness of the law is a really common question in the HSC so it's pretty important you know how to answer it.
