Hi,

Can someone explain to the process of the ratification? From international law to domestic law. How does it work?

And if a question asks: What are the process of ratification?----->How should I answer that to get full marks.

THANKS.

This is an excerpt from my HSC Legal Studies notes:

"- Australia is a dualist system → signing a treaty does not make it enforceable. Needs to be ratified and subsequently passed by the legislature
- Ratification = the proposal of codification of international law documents into domestic statute laws
- Domestic law is enacted to embody the principles of international human rights treaties e.g Sex Discrimination Act 1984 (cth) = The Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) 1979"

Hope this helps.
