Hey guys,

I had a simple question, can MedEntry sue you for selling their material.

Many people on this forum seems to be selling it but is it possible for them to sue you.

I had put an ad on gumtree and they contacted me with the following msg:

From: MedEntry Legal
WITHOUT PREJUDICE

MedEntry is the legal owner of the Intellectual Property contained on the website www.medentry.edu.au and its associated websites. It has come to our attention that you are advertising and offering items contained in those materials for sale on Gumtree https://www.gumtree.com.au/s-ad/ade...uide-w-practice-drills-n-much-more/1155404405

This represents a blatant infringement of MedEntry’s intellectual property rights. If you do not immediately remove your advertisement, we will seek an injunction, subpoena your personal details and take legal action. MedEntry has in the past, and will prosecute (through its lawyers, Norton Rose Fullbright) any individual or organisation that breaches MedEntry’s intellectual property rights – please see http://www.medentry.edu.au/resource...inds-dallas-gibson-of-medical-entrance-guilty and http://www.medentry.edu.au/resources/news/49-news/220-dallas-gibson-of-medical-entrance-bankrupt

I have since removed my ad to respect their request but i was just qurious.

Thanks,
Kush A. Patel

Yes, it is possible for them to sue you since they owe intellectual property rights to any materials they create/produce and people selling their materials is a breach of their consent for reproduction-it is a bit like pirated movies (but this time, for low amount of price).
So yes, refrain from doing it particularly where they are vigilant about those who breach their conditions and terms (When you sign up, it is likely you would have agreed to set of conditions, highly likely one of those conditions is you don't redistribute their resources without permission, and if you do, you can be held in breach of that contractual agreement and they can sue you (and probably use you as a case to deter others from doing the same thing)
