Robin and Jason were financially hard up. Both had been unemployed for almost 18 months and their saving were fast running out. Robin and Jason had 3 children to support and were paying off their modest home. They were currently 2 mortgage payments behind and there appeared little hope of gaining employment in the near future.

One day Jason came home with a substantial amount of money. Robin was thrilled until she learnt how he had obtained the money. Jason showed robin a small fire arm and told her that he had been involved in a burglary at the local TAB, robbing a man who had just left the TAB. The amount stolen was $3345.

In his rush to escape, Jason had crashed into a parked car. In the car was an elderly woman passenger waiting for her husband to return. She had suffered head injuries and was in a serious condition in hospital. Jason had no knowledge of this woman and her injuries.

Two days later, the police arrived to question Jason and robin. Jason refused to open the door and a little while later the police heard 2 shots. When the police tried to enter the building, they were fired on and had to take shelter and call for reinforcements. Jason had taken his family hostage.

The siege entered a second day. The police attempted to rush the building but one officer was wounded in the attempt. The police negotiator spoke with Jason to establish that his wife and children were safe, and he also told Jason about the subsequent death of the woman his car had hit. That evening, Jason surrendered to the police.

Questions:

1- What crime could robin possibly be charged with?
2- List the possible charges against Jason. (12 in total)
3- Identify the range of punishments that Jason could face and state why? Which of these punishments would not apply to Jason?

I only need help with question 2...the others is all good.

Common Assault: s 61
Assault occasioning actual bodily harm: s59 (against elderly woman)
Assault occasioning GBH (against elderly woman)
Constructive murder (of elderly woman)
Manslaughter by dangerous and unlawful act (of elderly woman)
Kidnapping
Assault against police officer: s60
Assault occasioning actual bodily harm: s59 (against police)
Assault occasioning GBH (against police)
Possibly also s195: destroying or damaging property
