So I guess the answer would be B then as the executive applies the legislation

Personally i thought it was A because the judiciary are able to make human rights law (i.e. Toonan, Mabo (if you count that as HR), Dietrich)

Curious, why A for 17?. I think its C. The question states defendant so its a criminal offence. Criminal offences can be summary. The case of DietrichvQueen already shows us that there is no guarenteed right to a lawyer, so thats obviously gone. A hearing is still heard in summary offences, even if its a commital hearing. The only thing which is no longer possible is bail since the crime is not of indicatable nature.
