How is it D then?
caution and warning is before conviction, so since conviction has already happened best answer would be D

do we need to be specific and mention a specific section
depends what you want to discuss
local court diversion --> s12, 14, 15 (local court offences)
fitness to plead --> s36, s37, s38, s39 (district + supreme court offences)

also why the special verdict (for defence of Mental Health Impairment or Cognitive Impairment) was changed from 'not guilty by reason of mental illness' to ‘act proven but not criminally responsible’

its his first recorded conviction so that means it cant be a caution or a warning cause those arent recprded. and community service is the next less harshest peanelty

my teacher is a hsc marker and he said no u need 3 on one defence each. i mean the question is literally says defencES
no but because it says "with references to the criminal justice system", u can do just one on defences and the other 2 on wtv not all

for the cssa qn my cohort all got clowned by the legal teachers for thinking we could right only abt defences when u only needed like 1 para on it
and my teacher also said some other school that did the cssa paper got a hint and got told they didnt have to solely talk abt defences 😭 honestly is that even allowed
